“Certainly,” says Steve. “California Probate Code Section 8120 outlines the procedure. Essentially, it involves three primary components: publishing a notice in a local newspaper for three consecutive weeks, mailing individual notices to all known heirs and beneficiaries identified through the will or intestate succession laws, and notifying known creditors using Form DE-157. This form serves as an official notification that the estate is open for probate, allowing creditors a limited timeframe to submit valid claims against the estate.”

I imagine there can be situations where locating heirs or beneficiaries proves challenging?

“You’re right,” Steve acknowledges. “Sometimes, we encounter cases where contact information for heirs is outdated or unavailable. In such instances, we employ various investigative techniques like online searches, reaching out to family members, and even utilizing private investigators to locate the missing individuals.”

He pauses, recalling a past case. “I remember one instance where an heir resided overseas and had severed all ties with their family. It took considerable effort, but we ultimately located them through social media and were able to ensure they received their rightful inheritance. These situations highlight the importance of diligence and persistence in probate proceedings.”
