Marshaling Estate Assets
Certainly, Brenda. One crucial step in the probate process is what we call “marshaling the estate assets.” Essentially, this involves identifying and inventorying all the assets that belonged to the deceased individual. This can include bank accounts, real estate, vehicles, investments, personal belongings – anything of value.
It’s a meticulous process that requires careful attention to detail. Accordingly, we often work closely with the executor or administrator appointed by the court to ensure a comprehensive and accurate inventory is created.
We then prepare formal documentation known as an Inventory and Appraisal (Forms DE-160/161) which details each asset, its estimated value, and any outstanding debts or encumbrances associated with it. This document is filed with the court and serves as a foundation for the subsequent steps in probate.
I recall a case where we were dealing with a sizable estate that included multiple properties scattered across the state. Tracking down deeds, mortgage information, and property appraisals was quite challenging. Nevertheless, through diligent research and collaboration with title companies and real estate agents, we successfully marshaled all the assets and provided the court with a complete and transparent picture of the estate’s holdings.
A recent study by the American Bar Association found that incomplete or inaccurate asset inventories are a common source of delays and disputes in probate proceedings. Consequently, it underscores the importance of having an experienced probate attorney guide you through this critical stage.
