It’s crucial to be thorough and accurate because these assets will ultimately be distributed to the heirs or beneficiaries according to the terms of the will or state intestacy laws. Ordinarily, this process involves obtaining statements from financial institutions, appraisals for real estate and valuables, and meticulously documenting everything. Consequently, it requires a good deal of organization and attention to detail.
Moreover, failing to properly marshal assets can lead to complications down the road. For instance, if an asset is overlooked during this stage, it might be missed in the distribution process, potentially leading to legal disputes among heirs.
Barbara Jenkins: I imagine there have been instances where finding and accounting for all assets hasn’t been straightforward.
You’re right; sometimes things aren’t as clear-cut. I recall a case where a client’s father had hidden a substantial sum of cash in his home—something none of his family members knew about. It took some detective work to uncover it, but ultimately we were able to include it in the estate inventory and distribute it accordingly.
Notwithstanding these occasional challenges, a well-organized probate process helps minimize delays and ensures that all assets are handled fairly. According to a 2021 study by the American Bar Association, approximately 70% of estates go through probate without any significant issues.
