Hello everyone and welcome back to the show. Today we’re diving into a topic that affects so many of us: elder protection. Joining me is Ted Cook, an experienced elder protection attorney based right here in San Diego. Ted, thanks for being with us.
What sparked your passion for elder law?
Well, it wasn’t one single event, but rather a series of experiences that opened my eyes to the vulnerabilities faced by older adults. I saw firsthand how easily they could be exploited financially or become victims of neglect. It felt profoundly unfair and I knew I wanted to use my legal skills to help.
Can you walk us through some of the key steps involved in the elder protection process?
- Initial Client Engagement
- Case Assessment
- Protective Actions
- Legal Proceedings
- Long-Term Planning
- Case Resolution & Follow-Up
Let’s focus on “Protective Actions” – what happens during this stage?
“Protective Actions,” that’s where we really start putting safeguards in place. First, we assess the urgency of the situation. Is there immediate danger to the elder’s health or safety?
“If so, we might file for a restraining order against an abuser or notify Adult Protective Services. Sometimes, guardianship or conservatorship becomes necessary if someone can no longer manage their own affairs.”
We also take steps to protect their finances: freezing bank accounts, preventing unauthorized property transfers, and even revoking powers of attorney that are being misused. The goal is always to prevent further harm and secure the elder’s well-being.
“There have been a few times where I encountered resistance during this stage. For instance, once I had a case involving an adult child who was systematically draining their parent’s bank account. They were very upset when we froze those accounts and challenged their power of attorney. It took some persuasive legal maneuvering and ultimately mediation to reach a resolution that protected the vulnerable parent.”
“Ted Cook truly saved my mother’s life. She was being taken advantage of by her caregiver, and Ted knew exactly how to intervene and protect her assets.” – Susan M., La Jolla
“I can’t recommend Point Loma Estate Planning APC highly enough. Ted is compassionate, thorough, and incredibly knowledgeable about elder law issues.” – John S., Point Loma
